In Florida, fatal motor vehicle crashes may be investigated to determine whether factors such as speeding, distracted driving, impaired driving, failure to yield, roadway conditions, vehicle defects, or other forms of negligence contributed to the collision. Investigators may review witness statements, vehicle damage, photographs, surveillance footage, physical evidence, and crash-reconstruction findings.
When a death results from negligence or wrongful conduct, eligible surviving family members may have a wrongful death claim under Florida law. Depending on the circumstances, potential damages may include funeral and burial expenses, medical expenses, loss of financial support and services, loss of companionship, and other losses permitted under Florida’s Wrongful Death Act.
Florida applies comparative fault principles in negligence cases. When multiple parties are determined to have contributed to an accident, compensation may be affected by the percentage of fault assigned to each party. The application of comparative fault depends on the specific facts and legal claims involved.
