In Florida, fatal motorcycle crashes are investigated to determine whether driver negligence, unsafe turns, speeding, distracted driving, impairment, roadway conditions, or other factors contributed to the collision.
Investigators may review crash reports, witness statements, surveillance footage, vehicle damage, motorcycle condition, and other available evidence when determining fault and liability.
Florida follows a modified comparative negligence system, meaning an injured person or surviving family member may recover damages if they are found to be 50% or less at fault for the crash. Any compensation awarded may be reduced by the percentage of fault assigned.
In fatal motorcycle accidents, surviving family members may have legal options under Florida wrongful death laws. Potential claims may involve medical expenses, funeral costs, lost financial support, property damage, and other damages allowed under state law.
Understanding insurance coverage, liability issues, and legal rights can help families affected by serious motorcycle collisions navigate the claims process.
