Davenport Man Arrested After DUI Crash Kills 28-Year-Old Woman, Deputies Say

Davenport, Florida (August 12, 2026) – A man has been arrested months after a deadly crash in Davenport that killed a 28-year-old woman, according to the Polk County Sheriff’s Office.

According to deputies, the crash occurred around 2:34 a.m. on May 22 near the intersection of Home Run Boulevard and Westview Road. Investigators said a 2019 BMW was traveling westbound when the driver entered a curve and lost control.

The BMW left the roadway, struck a power pole, continued down a slope, and rolled multiple times. Three people were inside the vehicle at the time of the crash.

The driver, identified as 26-year-old man, and the rear passenger were ejected from the vehicle. The front passenger, who deputies said was the only occupant wearing a seatbelt, remained inside the vehicle and was evaluated at the scene before being cleared.

Rodriguez was transported to a hospital for treatment. The rear passenger was also hospitalized and later died from her injuries. She was 28 years old.

Investigators said a blood sample taken from Rodriguez immediately after the crash showed a blood alcohol concentration of 0.18, more than twice Florida’s legal limit of 0.08.

According to deputies, surveillance video showed Rodriguez consuming several alcoholic beverages at a nearby bar before the crash. Detectives also determined that his driver’s license had been suspended since December 2025.

Investigators reviewed the BMW’s crash data recorder and determined that the vehicle was traveling approximately 117 mph in a 25-mph zone at the time of the collision, according to the Sheriff’s Office.

Detectives subsequently obtained an arrest warrant. Rodriguez was taken into custody after being released from the hospital on Thursday.

Polk County Sheriff Grady Judd described the alleged speed and impairment as reckless and deadly and said the crash resulted in the death of an innocent passenger.

Man faces charges including DUI manslaughter, vehicular homicide, knowingly driving with a suspended license involving death, and DUI with property damage or personal injury to another person.

The charges are allegations, and Rodriguez is presumed innocent unless and until proven guilty in court.
